1. Who we are

These Terms govern your use of the Dianock AI service (the “Service”), provided by Dianock AI (“we”, “us”, “our”). By creating an account or otherwise using the Service, you agree to these Terms.

2. Eligibility & accounts

You must be of legal age in your jurisdiction to use the Service. If you are using the Service on behalf of an organization, you confirm that you have authority to bind that organization. You are responsible for keeping your credentials confidential and for all activity under your account.

3. Acceptable use

You must not misuse the Service, including by:

• using it for unlawful purposes, fraud, or spam;
• infringing the intellectual property or privacy rights of others;
• interfering with the Service's security, scraping, probing, or distributing malware;
• using outputs to generate illegal content, hate speech, deepfakes, malware, or content that exploits minors;
• attempting to reverse engineer, resell, or circumvent technical limits of the Service.

4. AI outputs & user responsibility

You are responsible for your prompts, how you use outputs, and verifying the accuracy of outputs. You confirm you have the rights necessary to any content you submit. Outputs may be inaccurate and should not be relied upon as professional advice (legal, medical, financial, or otherwise) without human oversight. We may filter, refuse, or remove outputs and may suspend accounts that violate these Terms or that submit repeated infringement claims.

5. Intellectual property

We retain all rights, title, and interest in the Service, including its software, documentation, models, and branding. We grant you a limited, non-exclusive, non-transferable right to use the Service within your selected plan. Subject to applicable law and your plan, you retain ownership of inputs you submit and outputs generated for you.

6. Service availability

We work to keep the Service available and reliable but do not guarantee uninterrupted or error-free performance. We may modify or discontinue features at any time.

7. Payment, subscription & taxes

Payments are processed by Stripe, our payment provider. Subscription, billing, cancellation, and refund mechanics are governed by these Terms and our Refund Policy. Card data is handled directly by Stripe and never stored on our servers. You are responsible for any applicable taxes in your jurisdiction unless Stripe collects them on our behalf at checkout.

8. Suspension & termination

We may suspend or terminate your access for material breach of these Terms, non-payment, security or fraud risk, or repeated violations of acceptable use. On termination, your right to use the Service ends and we may delete account data after a reasonable export window.

9. Disclaimers & liability

To the fullest extent permitted by law, the Service is provided “as is” without warranties of any kind, express or implied (including merchantability and fitness for a particular purpose). Our aggregate liability for any claim arising from the Service is capped at the fees you paid us in the 12 months preceding the claim. We exclude liability for indirect, consequential, or special damages (including loss of profits, data, or goodwill), except where excluded by law.

10. Indemnity

You agree to indemnify us against claims arising from your content, your unlawful use of the Service, or your violation of these Terms.

11. Governing law

These Terms are governed by the laws applicable at our place of business, without regard to conflict-of-laws principles. Disputes will be resolved in the courts of that jurisdiction.

12. Changes

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance.
